Division 5 - Sound Amplifying Devices
SEC. 17.5-1 DEFINITIONS. For the purpose of this Division, whenever the following term appears in this Division 5, it shall have the following meaning, unless a different meaning is clear from the context.
Sound amplifying device - means any device utilizing electric current which amplifies a musical instrument, tuner, phonograph record, magnet tape, any electronically synthesized sound or the human voice.
SEC. 17.5-2 NOISE PROHIBITED. It shall be unlawful to use or operate a sound amplifying device, so that the device produces loud and raucous sounds at a distance greater than 50 feet from said device unless one has obtained a permit to do so from the Chief of Police or his designee(s).
SEC. 17.5-3 PERMITS - APPLICATION. Anyone desiring to use or operate a sound amplification device beyond the limits stated in SEC. 17.5-2 must make application to the Chief of Police or his designee for a sound amplification permit. Such application shall state whether live or recorded sound will be amplified; and if live, the names and addresses of the performers shall be provided. The Chief of Police or his designee shall issue a permit to anyone who applies for the same. Each permit is valid only during the time specified in the permit. Each permittee shall comply with all the terms of this ordinance, including but not limited to SEC. 17.5-4 and shall be responsible for seeing that the sound amplifying device is used or operated in accordance therewith. - The permit shall be only in effect from 10:00 a.m. to 11:00
p.m., local time, Sunday through Thursday and 10:00 a.m. to
12:00 midnight Friday and Saturday. (Amended 7/2/84)
- The sound amplification device shall not produce loud and
raucous sounds greater than 100 feet from the device.
- The permit shall not allow loud and raucous sounds within 50 feet of a school or church during the hours they are in session or within 50 feet of a hospital or nursing home.
SEC. 17.5-5 NOISE WITHIN A MULTIPLE-FAMILY STRUCTURE. It shall be unlawful to use or operate a sound amplifying device so that the device produces loud and raucous sounds within a multiple-family structure at any time during the following hours:
- Between 11:00 p.m. on Sunday to Thursday, inclusive, and
10:00 a.m. on the following day;
- Between 12:01 a.m. and 10:00 a.m. Saturday; or
- Between 12:01 a.m. and 10:00 a.m. Sunday.

SEC. 17.5-6 EXEMPTIONS. The provisions of this Division shall not apply to emergency vehicles, warning or anti-theft devices, units of governments or carillons.
SEC. 17.5-7 VIOLATIONS. Any person who violates any provision of this Division, shall, upon conviction thereof, be fined not less than $25.00 nor more than $500.00.
