Chapter 19 - Amusements
Division 1 - General Provisions

SEC. 19.1-1 APPLICATION OF PROVISIONS. The provisions of this Chapter, except as to licensing and fees, shall apply to all public shows, theatricals, circuses and other amusements in the Town, whether specifically licensed in another article of this Chapter or not.

SEC. 19.1-2 PERMIT. No firm, corporation or person shall erect, construct, keep or maintain any general amusement establishment, including theaters, for which an admission fee is charged, within the Town of Normal, without first making application and obtaining a permit in the manner hereinafter provided.

SEC. 19.1-3 APPLICATION. Application herein required shall be made to the Town Council by the person, firm or corporation desiring to conduct an amusement establishment, and shall in writing specify the proposed location of said establishment, describing the method of conducting same and operation of the general amusement area itself. The Town Clerk shall issue a permit herein provided for when said application has been received and approved by the Town Council. Said application shall be accompanied by a Certificate of Insurance showing the applicant has public liability insurance in the minimum amounts, as established by the Town Council. Said Council may, from time to time, set forth standards for particular amusement operations and they need not be the same for each type, but shall be based upon the proposed risk expected. Such insurance shall be written in the name of the applicant with an endorsement carrying the Town of Normal as an additional insured. Said applicant does further agree to indemnify and keep harmless the said Town of Normal, and its officers and employees from any and all suits or actions at law or equity, damages, costs, expenses and legal fees that may be incurred or sustained by said Town of Normal for or on account of injuries or damages sustained by any person or persons, either as to their person or property, occasioned in any manner by the granting of the license privilege or permission asked for herein. Said agreement shall also be recited in the permit issued hereunder and the acceptance of said permit shall be further agreement to so indemnify said Town, and a failure to promptly indemnify said Town shall revoke the license or permit issued. Failure to provide the necessary insurance or to indemnify said Town shall automatically revoke the permit or license herein granted.

SEC. 19.1-4 STATE OF REPAIR. All such general amusement establishments shall be kept in a good state of repair and in a condition so as not to endanger the safety of persons or property. The manager of said establishment shall be responsible for the conduct of the participants and shall see that said participants do not disturb the peace and quiet of others, and shall further see that the establishment is maintained within reasonable hours only. If the amusements are such as to require supervision, it shall be the duty of the management to provide adequate supervision at all times and such supervisors shall be uniformed while on duty.

SEC. 19.1-5 FEES. Said permit shall not be transferable and shall be issued and valid for a specified period of time, not exceeding a period of one year. (Amended 4/2l/75)
