MINUTES OF THE REGULAR MEETING OF THE NORMAL LOCAL LIQUOR COMMISSION HELD IN THE COUNCIL CHAMBERS, CITY HALL, 100 EAST PHOENIX AVENUE, NORMAL, MCLEAN COUNTY, ILLINOIS, MONDAY, MARCH 17, 2003.

  1. CALL TO ORDER:

    Commissioner Koos called the regular meeting of the Normal Local Liquor Commission to order at 6:37 p.m., Monday, March 17, 2003.
     
  2. ROLL CALL:

    The Acting Secretary called the roll with the following persons
    PRESENT:    Commissioner Koos and Board Members Garrett Scott, Cheryl L. Gaines, Adam Nielsen, Craig Ward.
    ABSENT: Board Member Sonja Reece arrived at 6:42 p.m.

    There were no items removed from the Omnibus Vote Agenda.

    Mr. Scott moved, seconded by Mr. Ward, the Commission approve the Omnibus Vote agenda.

    Attorney Wayne Karplus reported Akemi Homestyle Japanese Restaurant is now in full compliance of the fire code. He recommended the renewal of the liquor license on the condition this establishment submits a floor plan by May 1, 2003.

    MOTION:

    Mr. Scott moved, seconded by Mr. Ward, the Commission approve the renewal of the liquor license on the condition this establishment submits a floor plan by May 1, 2003.

    AYES: Scott, Gaines, Nielsen, Ward, Koos.
    NAYS: None.
    ABSENT: Reece.

  3. MAC’S CONVENIENCE STORES, LLC, d/b/a MAC’S #150, 1606 N. Main Street CLASS A LIQUOR LICENSE – Fee Paid in Full - $3,000.00.

    Attorney Wayne Karplus recommended the renewal of the liquor license on the condition this establishment replace the dead plants and maintain the landscaping.

    MOTION:

    Mr. Nielsen moved, seconded by Mr. Ward, the Commission approve the renewal of the liquor license on the condition this establishment replace the dead plants and maintain the landscaping.

    AYES: Scott, Gaines, Nielsen, Ward, Koos.
    NAYS: None.
    ABSENT: Reece.
    Motion declared carried

  4. FOUL SHOTS ONE, INC., d/b/a Foul Shots, 706 ½ W. Beaufort Street – Class C Liquor License – One-Half Fee Paid - $1,500.00:

    MOTION:

    Mrs. Reece moved, seconded by Mr. Ward, the Commission approve the renewal of the liquor license with the stipulation this establishment submit monthly reports regarding liquor and non-liquor sales. After six months, a hearing will be held to determine if the requirement is met regarding sales from non-liquor items.

    AYES: Scott, Gaines, Nielsen, Ward, Reece, Koos.
    NAYS: None.

  5. FIRST APPEARANCES – LIQUOR CODE VIOLATIONS:

      Attorney Wayne Karplus reported this was the first offense for Bloomington Motel Partners, Ltd., d/b/a Holiday Inn, #8 Trader’s Circle, and a stipulated agreement had been reached for this offense. Mr. Karplus recommended a fine in the amount of $250.00.

      MOTION:

      Mr. Nielsen moved, seconded by Mr. Ward, the Commission recommend a fine in the amount of $250.00.

    2. CASEY’S GENERAL STORES, INC., d/b/a/ Casey’s General Store, 1930 N. Linden Street – CASE # 2003-03

      Attorney Wayne Karplus reported this was the second offense for Casey’s General Store, 1930 N. Linden Street and this establishment is requesting a hearing on April 21, 2003 at 5:30 p.m.

      MOTION:

      Mr. Scott moved, seconded by Ms. Gaines, the Commission schedule a hearing on April 21, 2003 at 5:30 p.m. for consideration of the second offense for Casey’s General Store, 1930 N. Linden Street.

      AYES: Scott, Gaines, Nielsen, Ward, Reece, Koos.
      NAYS: None.

    3. MAC’S CONVENIENCE STORES, LLC, d/b/a Mac’s #21, 1701 Parkway Plaza Drive – CASE # 2003-04

      Attorney Wayne Karplus reported this establishment would like to request a sanctions only hearing on April 21, 2003 at 5:30 p.m.

      Rick Cagle of Mac’s Convenience Stores, was present and agreed to a hearing on sanctions only.

      Mr. Ward moved, seconded by Mrs. Reece, the Commission consider sanctions for this offense at the hearing on April 21, 2003 at 5:30 p.m. for Mac’s #21, 1701 Parkway Plaza Drive.

      AYES: Scott, Gaines, Nielsen, Ward, Reece, Koos.
      NAYS: None.

    4. MEET, INC., d/b/a Fast Stop, 817 W. College Avenue – CASE # 2003-05

      Attorney Wayne Karplus reported this was the first offense for Meet, Inc., d/b/a Fast Stop, 817 W. College Avenue and a stipulated agreement had been reached. Mr. Karplus recommended a fine in the amount of $250.00 for this offense.

      MOTION:

      Mrs. Reece moved, seconded by Mr. Ward, the Commission recommend a fine in the amount of $250.00.

      AYES: Scott, Gaines, Nielsen, Ward, Reece, Koos.

    5. CONVENIENT FOOD MART, INC., d/b/a Soooo Convenient, 509 Raab Road – CASE # 2003-06

      Attorney Wayne Karplus reported a stipulated agreement had been reached with Convenient Food Mart, Inc., d/b/a Soooo Convenient, 509 Raab Road. Mr. Karplus recommended a fine in the amount of $2,000 be paid in three installments as follows: $750 by April 1, 2003, $750 by May 1, 2003 and $500 by June 1, 2003. Mr. Karplus reported a three day suspension also had been served March 14, 2003 through March 18, 2003.

      MOTION:

      Mrs. Reece moved, seconded by Mr. Ward, the Commission recommend a fine in the amount of $2,000 to be paid in three installments: $750 by April 1, 2003, $750 by May 1, 2003 and $500 by June 1, 2003 .

      AYES: Scott, Gaines, Nielsen, Ward, Reece, Koos.
      NAYS: None.

    6. BUDGET LIQUORS, INC., 200 S. Linden Street – CASE # 2003-07

      Attorney Wayne Karplus reported this was the second offense within three years for Budget Liquors, Inc., 200 S. Linden Street and a stipulated agreement had been reached with this establishment. Mr. Karplus recommended a fine in the amount of $1,000 for this offense.

      MOTION:

      Mrs. Reece moved, seconded by Mr. Ward, the Commission recommend a fine in the amount of $1,000.

      AYES: Scott, Gaines, Nielsen, Ward, Reece, Koos.
      NAYS: None.

    7. MERCEDES RESTAURANTS, INC., d/b/a Alexander’s Steakhouse, 1503 E. College Avenue – CASE # 2003-08

      Attorney Wayne Karplus reported this was the second violation within three years for Mercedes Restaurants, Inc., d/b/a Alexander’s Steakhouse, 1503 E. College Avenue and a stipulated agreement had been reached with this establishment. Mr. Karplus recommended a fine in the amount of $750.00 for this offense.

      MOTION:

      Mr. Nielsen moved, seconded by Ms. Gaines, the Commission recommend a fine in the amount of $750.00.

      AYES: Scott, Gaines, Nielsen, Ward, Reece, Koos.
      NAYS: None.
      Motion declared carried.
       
  6. REPORT FROM FINANCE DEPARTMENT:

    The Finance Department reported all required establishments have met the 51% non-liquor sales requirement, with the exception of Foul Shots One, Inc. at 34.9% non-liquor sales for a six-month reporting time. Financial records are on file with the Liquor Commission Secretary for the Commission’s review.
     
  7. REPORT FROM LIQUOR COMMISSION SECRETARY:

    We have 40 establishments in Normal licensed to sell alcoholic beverages. The breakdown of those licenses is as follows:
