Americans with Disabilities Act

ADA Requests

It is the policy of the Town of Normal to endeavor to reach and maintain compliance with the Americans with Disabilities Act (ADA) which gives civil rights protection to persons with disabilities in the provision of, or access to, all Town services, programs, activities and facilities. Any person with an ADA qualifying disability may request a reasonable accommodation to gain access to, or participate in any Town offered service, program, activity and facility by contacting the staff of the responsible Town Department or by using the Town’s On-line ADA Request.

Each Town department is accountable for attempting to reasonably accommodate any valid request received in a timely manner prior to the start of a Town program, service or activity. The Town department will discuss with the person options which may reasonably accommodate them and may ask for documentation confirming an ADA qualifying disability. Any accommodation must not fundamentally alter the Town program, service or activity. The Town may also consider other factors allowed by Title II of the ADA in an attempt to reasonably accommodate a valid request.

Grievance

Should a person with a disability be unable to reach a mutually satisfying accommodation with the Department staff he or she may file a grievance with the Town’s Compliance Officer using this “ADA Non-Compliance Grievance” link.

A completed "ADA Non-Compliance Grievance" will be electronically forwarded to the Compliance Officer to investigate the grievance. The Compliance Officer may confer with the Grievant, Department staff, health officials, representatives from disability groups, or other pertinent parties. The Compliance Officer will issue findings on the reasonableness of the Town department's accommodation or lack of accommodation. The Compliance Officer may also make alternate methods or means of reasonable accommodation. All parties will receive a copy of the findings of the Compliance Officer. The investigation will begin, and the findings shall be rendered in writing, within twenty-one (21) days of the receipt of the completed “ADA Non-Compliance Grievance and documentation confirming a valid ADA disability.”

The findings of the Compliance Officer not satisfactory to the Complainant may be appealed to the City Manager (or designee) via written correspondence within seven (7) days of the date of the decision by the Compliance Officer. Appeals may be sent to the City Manager, 100 E. Phoenix Avenue, Normal, IL 61761.

All Town departments and staff will cooperate fully in the Town's ADA efforts. Department Directors and other Supervisory Personnel will be expected to treat all employees, customers, and citizens of the Town fairly and equally as required by the law. Individual employees are expected to treat their co-workers, customers, and citizens of the Town with courtesy and respect.
